Use of Frequencies in the ranges of 2.4 GHz and 5GHz bands
2.4 -2.4835 GHz
Transmission of signals or use of equipment in any form on these bands for Commercial purposes without a frequency authorization obtained through the National Telecommunications Regulatory Commission is illegal.
All concerned operators/companies or any person(s) using these band should note that it is a criminal offence to operate on any of the above frequency not duly assigned by the Commission.
The following sections of the Telecommunications Act 31 of 2000 states:
Section 28 (2) where a frequency authorization is necessary for or in relation to the operation of a telecommunications network or a telecommunications service, a person shall not operate that network or service without that authorization.
Section 28 (4) A person who contravenes subsection (1) or (2) or (3) commits an offence and shall be liable on indictment to a fine of not exceeding one million dollars or to imprisonment for a period not exceeding ten years.”
The consequences of such act may lead to imprisonment, sanction and forfeiture of equipment used in operating the illegal services.
In view of the above, the Commission hereby gives a 14-days’ notice to all unlicensed operators using the above listed frequency bands to forthwith vacate and desist from further transmission of signals or use of equipment in any form on this bands without authorization obtained through the National Telecommunications Regulatory Commission
The Commission shall without further notification and upon expiration of the stipulated deadline commence appropriate enforcement action.
